Christopher ‘Kim’ Thompson has practiced in Middle Tennessee for over 33 years. Before I ever became a lawyer, I observed my father sign a document called a irrevocable trust. He was so weak because of his illness that he could barely sign his name. After he died, my mother would need money from time to time from the trust but she had problems getting needed funds. Sometimes, the trustee would deny her requests. She had to hire a lawyer at a very high hourly rate. The lawyer had to file a lawsuit to undue the mess all because no one that sold my Dad the trust ever followed up with my mother after my dad died. No one ever talked to her about whether the irrevocable trust met her needs. I have also seen too many people have to participate in probate court because they didn’t have a Will. This all could be avoided with proper estate planning.
